In the end Algore has no one to blame but himself.

His legal strategy conflicted with his political strategy. Al needed to get the certification deadline extended so that he could demonstrate that there was a possibility of gaining additional votes. In doing so he dramatically limited the time of the Contest phase. Alhough the 7-2 majority of the Supreme court agreed that the method of counting was unconstitutional, the tight time frame left, brought on by his original lawsuit (Palm Beach vs. Harris) was his real undoing. The limit on the contest phase hit him in two ways, 1, the ruling and procedures of the Florida supreme court, did not allow for judicial review as called for in Florida law. 2. Going past December 12 ran afoul of the legislative intent to have electors within the safe harbor provision of federal law.

The democrats were so fond of playing legal gotcha earlier in this oddesy, pointing out that the GOP could have asked for recounts in other counties and that they could have contested other counties.

It is Poetic justice that they were gotten by their own gotcha.

No matter how slim a President wins the electoral vote or if he loses the popular vote, these are not impeachment offenses.

How can it be clear Bush lost the popular vote if you buy the Democrat's argument that all the votes must be counted? Nationally, 2 Million votes were apparently "never counted" because they were declared an overvote or undervote.

Regarding Florida, the only thing that's clear is that the Democrats made a tactical error in fighting only for standardless "selective recounts" rather than standards based statewide recounts. The entire case was opportunistic rather than principled.

The Democrats should have fought for a "fair and accurate" recount to begin with... they chose not to. The only fair and as close to accurate way to recount all the ballots is to perform a completely contiguous statewide recount from beginning to end with machine counts supplimented by hand counts using standards for the two main classes of ballots, punch and optical which could have been set by the Florida Supreme Court.

This could have been completed more than once over the last month had the Democratic legal team chosen this path. My question is, why didn't they choose this path? What were they afraid of? Although the Republicans would have fought it, it's clear now that it would have held up in the supreme court.
