I think the buy-out rumor is being overplayed as well. But, keep in mind the spin-out (Agere) has better technology and a more complete portfolio than does JDSU. JDSU has a cap of $63B... the same as LU's cap at this price. So you get LU and their customer base for free... and this ain't chopped liver. There are better shorts. Yes, it is extended and you could short for a gap fill.... but then, if NOK does announced a buy-out you'll be caught with your pants down. Too much risk to be short that stock. OG
