Karen, I really think that everyone has been doing the best they could, within the scope of their assigned responsibilities. However, I agree that the USSC decision qualifies as judicial activism, as did the FSC decision. The former was true because they have in effect declared unconstitutional the way that hand recounts have been practiced in many states for many years, and the latter is true because they have expanded the scope of election contests beyond how they had previously been used in the State of Florida. I hope this case will convince the states to spend whatever money is needed to bring their voting equipment up-to-date enough that the issue will become moot in future elections.
