Since the SCOTUS did not, in fact, rule on any substantive issue when it vacated the first Florida SC ruling, but demanded clarification, the good professor is precisely wrong that Boardman was superceded.The opinion was vacated because it was its reasoning was murky, and prevented proper federal adjudication......
