That's the reason Gore team chose to pursue hunting for votes using a very opportunistic approach. You can fault the Gore legal team for many things, but they are not stupid.

BOISSE had followed the above rules in the contest phase of the election
1)there would have been plenty of time to set a standard
2)the only court decision would have been on the legitimacy of a partially punched ballot counting as an indication of voter intent. The Fla. supreme court
obviously would have upheld any standard agreed by all parties.
3)there would have been plenty of time to do the recount
4)Bush would have won anyway.


If the Florida Supreme court, or anyone else for that matter, had set standards, other than the ones set in the statute they would have been equally reversed on appeal for "changing the rules" after the election. Was this not one of the Rep complaints on at least two appeals?

Statewide counting with a uniform standard agreed upon by both candidates.

Gore proposed this very early in the legal process. Bush flatly rejected the proposal and branded it a political scheme.
