This is different, btw, from saying that the particular behavior of the Broward County canvassing board was unconstitutional, that they abused their discretion.

How so? Imo, it is exactly because they were so lenient, almost to the point of deliberately trying to "mine" votes for Al Gore, that any sense of objectiveness was lost.

The law SHOULD have some implicit flexibility in it, but only so far as it doesn't strain credulity. In their rabid fervor to "count every vote" -so long as it was a vote for Gore-, they provoked the outrage of every conservative out there who saw the inherent violation of the rights of every other voter who properly and legally cast their ballots.

In sum... it is all well and good to try to accomodate the apparently lazy and inattentive voters of our nation, but not to the extent that we're willing to cast out any sense of objective and clear-cut legal standards.
