Perhaps you should read the FSC Bush vs Gore and see what a twisted piece of logic that was. And remember 7 say unconstitutional. Only disagreement is the remedy.

Yes, it was 7-2 - seven of the nine justices found that the Florida Supreme Court's recount scheme was unconstitutional - and 5-4 for the specific remedy.
