I think the decision by the court to remand the FSC decision came at a time when it only could have been political. There was the original appeal by Bush, when the USSC effectively punted the decision back to the FSC. Then, they rule again and this time, the outcome being unfavorable to Bush, as cited by Scalia, reverses the decision and finally ends the race. I'm not doubting their authority, but frankly, Scalia makes me sick to my stomach. His opinion issued during the stay was so political it might as well been drafted by GW.
