Just out of curiousity, what do you think would have happened if the case had been remanded for the Florida Supreme Court to try again? Do you think the votes would have been counted and the appeals completed by December 18? That's the day that the Electoral College votes.

And if not, what then?

You're not looking at it objectively. The re-re-re-count was clearly unconstitutional. 4 of the justices believed it could be remedied and the other 5 believed any remedy imposed without extraordinary measures, which themselves might prove unconstitutional, was impractical.

If you were sitting on that court as an impartial justice, you'd have voted with the 7 and then with the 5.
