As a certain SI political poster in chief once admitted, "Roe is central". Yes, Bush would be wise to make his first Supreme Court appointee a pro-choice selection. That will diffuse the issue and go a long way to re-electing him in 4 years. By the end of his presidency, Bush could have appointed 4 or 5 justices.

Hi Daniel. I have downloaded the opinion, and seven out of nine Supreme Court justices DID rule that the decision by the Florida Supreme Court violated the Equal Protection Clause of the Constitution. The difference between the 5 and the 7 was on the remedy. I am on record as saying back when the issue of recount came up, that I had no problem at all with a manual recount using an objective standard, e.g., either the chads are hanging or there is a clear stylus mark if it didn't punch through. I also argued that the recount ought to be state wide and that all the ballots should be examined, not just the undercount. Seven of the Supremes agreed with me. I find that gratifying. As for the decision to stop the count, I can see the argument that it was high-handed, but it was also realistic. What would happen to Florida's Electors if the recount wasn't complete on the 18th? Would Congress accept their vote? I think not. Then ALL of Florida would be disenfranchised, and Gore would have the majority of Electors by default. That's dirty pool.
