Good point about the partisan nature of the Supreme Court. Anyone who thinks otherwise is naive. Anyone who thinks Roe v. Wade wasn't judicial activism is ignorant, to cite an example we are all familiar with.

But constitutional scholars can point to many, many decisions which can only be explained by looking at the political philosophies of the Justices, going all the way back to Marbury v. Madison. Dred Scott is another famous one. Lochner is one that is famous among scholars, although it's not well known among the general populace.

I remember "Impeach Earl Warren" billboards all over the South when I was a kid. I guess they were probably mad about Brown v. Bd. of Education.

The only thing I recall reading about Sauls' original decision was that there shouldn't be any more counting, because Gore hadn't proved it would change the results. I found the logic of that one slightly impenetrable.

As far as partisanship goes, I was always most amused by the Florida Bush campaign co-chair's declarations of legal infallibility in her personal interpretation of the election laws.

As far as being hypocritical goes, you might want to correlate all the whining by Republicans about Gore not giving up right away, versus close congressional elections in years past, where if Republicans lost, the appeals lasted for months. There was usually some debate in Congress as to whether the winning Democrats should be seated in January. B1 Bob and others got Congressional hearings and investigations the next year, too.
