His point was valid nonetheless. Stenberg vs. Carhart, which overturned the laws of 27 states banning partial-birth abortions, was decided by a single vote.

My recollection on Roe v. Wade was faulty. But the point remains many important decisions are 5-4. They are no less legitimate than 7-2 or 9-0 from a legal standpoint. JLA
