The majority voted on equal protection. Only 3 judges (Rehnquist, Scalia and Thomas) agreed that the FSC made new law that should be struck down -- they wrote a concurring opinion in which the other 2 judges in the majority did not join. 6 of the judges agreed that manual recounts are not per se unconstitutional 4 of the 6 thought that a standard was needed but 2 of them thought that there was insufficient time to adopt that standard and complete the recount by December 12 (a wholly artificial deadline), in as much as they rendered the decision at 10:30 pm on December 12 after staying the recount over the weekend.
