ACTV files patent infringement suit against Disney

NEW YORK, Dec 20 (Reuters) - ACTV Inc. (NasdaqNM:IATV - news), a maker of interactive television techology, on Wednesday said it had filed suit against Walt Disney Co. (NYSE:DIS - news), alleging that its ABC and ESPN networks used features that infringed on ACTV patents.

ACTV claims that the ``Enhanced TV'' feature used by ABC's ``Monday Night Football'' and ``Who Wants To Be A Millionaire'' and ESPN's ``Sunday Night Football'' infringes on three ACTV patents. The New York based company is seeking the halt Disney's use of the feature and is seeking monetary damages.

Disney subsidiaries ABC and ESPN were also named in the suit, which was filed in a New York federal court. Executives from Disney, ABC and ESPN were not immediately available for comment.

Enhanced TV allows viewers to use additional features via personal computers, such as answering the same questions as contestants on the hit game show ``Millionaire'' or additional statistics, polls and trivia during football games.

``We have made the licensing of our patents an integral part of ACTV's overall business strategy,'' said Scott Doyle, ACTV's chief intellectual property officer. ``We view the Disney litigation as a step we must take to protect our patents and support our licensing program.''

ACTV's shares closed at $4-29/32, touching a 52-week low of $4-5/16 in Tuesday's Nasdaq trading. Shares traded as high as $51-3/4 a year ago."
