Souter wanted to punt it to congress, but since the gang of 5 took the case, he had no choice but to question the EP issue. Breyer states, "But the federal legal question presented, with one exception, are insubstantial." So both felt the EP issue was a problem, i.e. unconstitutional, and both didn't want the case to begin with. In sum, 7 justices recognized the unconstitutionality of the recount. Time for you to admit it.
