They SEC doesn't care about people that would write and say someone misrepresented the share count. They are already aware of TIGI. I wouldn't doubt they are scrutinizing it. There are many other stock they monitor and as said by others move at glacial speed. That being said, you can't be certain how long ago the glacier started moving.
