Z, For your info, Judge R. Kaye retired early December. However, Florida court sometimes can call a retired Judge back to rehear certain cases. So, if a higher court remands the case down, he still can be the one who will hear the case. The Engle case is currently in the Third District Court. Decision by the District Court is not expected in next 10-12 months. If decision from TDC does not favor MO, you can be sure it will appeal again to state Supreme court and to US Supreme Court is necessary.
