I think the suit would be to invalidate the vote for Carnahan because he was dead. That would mean that Ashcroft would win because he received the only valid votes.

I hadn't heard that the seat would be open in 2002. Why would that be so since the term should run for 6 years?

Well, it's too late now, but I think that the GOP was shy because they thought they would be hypocritical to challenge it in the courts while condemning Gore for doing the same.

This is true.
The WSJ did run an article a month or two ago explaining how this was unconstitutional, but Ashcroft and the MRP did not want to challenge this.
There will be an election in 2002. Senator Bond's seat will be up in 2004.
