I agree that W will not be able to name ultra-conservative supreme court justices to the bench. Candidates having views similar to those of Renquist, Scalia and Thomas may have really tough time to get confirmed. However, if the confirmation process of Justice Thomas is of any guide, the person naming the candidate has advantage over the opposing party. The confirmation of Judge Thomas was a very nasty process with Ms Hill got involved. However, even the liberal senators who oppose the candidate in the end had to say that any benefits of the doubt must go to Thomas. I would say that it will be very difficult to vote against moderately conservative candidates such as O'Conner or Kennedy type of Justice.
