I think he is referring to Ronnie White, a Missouri Supreme Court Justice, whose nomination to a federal judgeship was defeated in the Senate. Ashcroft criticized his record on the death penalty.

I am sure this will be looked at in the Senate nomination process.

Ashcroft has appointed blacks to the bench when he was governor.

Mark, you can read all about it in today's edition of the New York Times. Ashcroft put a hold on an African American member of the Missouri State Supreme Court who was nominated for a federal district court judgeship on the now disproven claim he was soft on crime. When you examine the record of that judge, you find he was just as tough on crime as other members of the court. Ashcroft will have a tough time before the Judiciary Committee.
