You could be right. On the other hand, maybe he changed his position for political reasons. Analyst on NPR a few minutes ago speculated that Ashcroft will catch some heat during Senate confirmation hearings for his opposition and successful scuttling of Clinton's nomination of Ronnie White (African-American Missouri Supreme Court justice) to federal bench about year ago. Ashcroft's defense has been that White was "soft on crime." More to it than that, obviously.

I think we'll see some real fireworks in the Senate during some of these confirmation hearings, especially in the judicial arena ... in view of what the USSC did a few weeks ago.
