He has said he has no position in JDSU or SDLI at this time. He hasn't owned JDSU/SDLI for a while now, according to his public statements.

If you belive that he has committed the FELONY that you accuse him of then you should file a complaint with the SEC. It should be outrageously simple for them to look at trades transacted for his firm to see if he is trying to manipulate the stock. In fact, it's so simple to be discovered that he'd have to be a complete and utter moron to do it openly like that. The real manipulators are the ones who post under 20 different screen names at Yahoo, Raging Bull, and Silicon Investor.

He's said he has "no position" in the stock. Could it be he's just doing what a good markets writer should do - expressing his opinion and thoughts on the market??? Afterall, isn't that what subscribers to his site pay him for?

To think there's manipulation behind all of the man's stories is naive. He'd be investigated in a heartbeat.

Here's another definition for you:

Defamation: Communication which exposes a person to hatred,
ridicule, or contempt, lowers him in the esteem of his
fellows, causes him to be shunned, or injure him in his
business or calling. (Law of Mass Communications, Nelson
and Teeter).

Of the various ways in which a person may be lowered in
the estimation in which he is held, none has brought as
many libel suits as a false charge of crime.
