Union soldiers had a right to maintain their fort, despite whether it existed near South Carolina.

When the rebs fired against Sumter, they fired on America. Even then America did not retaliate. The rebs continued their assault even when Lincoln attempted to supply the American fort.

No way around it. The Confederacy started the war. Even if it had the right to secede, it had no explicit right to take federal property in the process.
