The problem is that the legal system is not sceintific. I point to the breast cancer litigation that has put several companies into bankruptcy. The NIH recently released long term studies showing breast implants do not result in an increased incidence of autoimmune disease. But that does not help companies previously found guilty of same in court.

Tort lawyers will use Harvard PH types who will testify that cellular phones "could" cause cancer. Also there experts will say there is no "irrefutable evidence" that cellular phones do not cause cancer. Torts shift the burden of proof in court and the companies are the ones that have to prove they are not guilty.

All it takes is one non-common sense jury to award multi-million dollar damages and the tort will smell blood in the water.
