Verizon is the nations largest CDMA carrier. Verizon still has some analog coverage in outlying rural areas. Most metroplolitan areas of any size have converted to CDMA

I believe that if they sue in an English court and lose, plaintif pays costs of the court and of the defendant. There have been some cases where this proved very costly indeed.
