Their position was always with CDMA the Q gets 100% of the royalties, but with WCDMA it gets, at mosts, 33%. So aren't they getting "less?" I guess it all depends on the meaning of "is."

It does depend on what it is 100% or 33% of. A $5 per unit royalty is 100% if the total royalties on that unit is $5, but 33% if the total royalties on the unit is $15 because there is additional technology included. Q is still getting their $5.
