I am trying to get you to recognize the general principle. The Cooper- Church Amendment was very likely unconstitutional. Whether the particular subterfuge were justified, it is understandable that the president should not feel legally bound, especially if he considered the lives of servicemen to be at stake, rather than awaiting litigation. I am not wholesale exonerating, I am propounding a dilemma. In the midst of a war, what responsible commander would allow the enemy sanctuary from which to raid his troops with impunity?
