OT Politics... It might be that I should have just shut up! I admit to not having read the constitution related to electing the President. I was just enjoying a 'what makes sense' rant about the absurd situation and being just a teeny bit provocative too.

I'm all for constitutions so it wouldn't really be too helpful for Bill Clinton to simply decide he doesn't like the result as decided by the Supreme Court majority. But there are a few unfortunate aspects to the electoral process.

Sometimes, constitutions aren't moral, even if they are legal and decided by 80% of Congress, the Senate and all of the Supreme Court judges. Sometimes people need to revise the law by defying it. Such a time is when freedom is circumscribed to such an extent that it becomes intolerable. For example, if a constitution makes it illegal for melanin-rich, people to vote or sit at the front of a public bus, or for women to have a job or for people to smoke dope or take medicines which they deem desirable for their health, or makes other racist, sexist or anti-freedom laws, then it is perfectly reasonable for people to defy those laws, using violence to gain their freedom and right to life. What if the law is that Jews have to report for a tattoo on their shoulder and report to a transport centre? When the law is a ass or immoral, it's time to revolt. But civil wars are very ugly and highly undesirable. Fortunately, democracies usually keep things steady enough that such situations don't arise.

While the constitution might well say exactly what should happen, I'm just interested in what might happen when push really comes to shove and an appointed rather than elected President Bush tries to get the Supreme Court, stacked with Republican appointees to jail an elected President Clinton whose time has expired. But what if there is no new validly elected President? It is all a great deal of fun and I imagine there are lots of constitutional lawyers with a wild gleam in their eyes having the time of their lives.

So, looks as though 6 January might be interesting.

I will NOT be surprised if there is a slight delay in the inauguration of El Presidenti Bush. But I really have no idea. Dick Cheny seems to have been unconstitutionally 'elected' due to false 'inhabitant' claims. Gee, this is quite a tangle.

Since I really don't know anything about it all, I think I'll just watch with amusement [and increasing concern as the share markets crumble]. I'm certainly not going to pretend I know what's going on, why, and who is in charge. Maybe Al Haig is!

PS: DWB, I think my comments were coherent, but perhaps ignorant and unreasonable. <It is another interesting perspective that Clinton should use his power as head of the military to preserve our freedom by circumventing the Constitution.> I imagine the President was made keeper of the gun, out of the barrel of which power grows, because the constitutional designers figured that when things really go down to the wire, it's better to have the military reporting to the President than to Congress. So he would use that power perhaps to re-establish constitutional rule in a constitutionally and judicially messy moment, not to circumvent it. I suppose all he could do is require new elections be held. Yes, I know, I should read more ... but that would spoil a good story with some facts.
