No wonder you don't want to match wits with right wingers What don't you understand about the thread header, Fangorn? This is a place for leftys to relax and not have to argue the Constitution with every conservative who wants to attempt to demonstrate how smart he is. You know, you were doing pretty well in the respectfulness department until your parting swipe. But you just couldn't help yourself.

I don't need to shred the constitution to do that. Anymore than I need to shred it to say that murder planned, is worse than murder by impulse. Due process means that all citizens will be treated equally under the law. If the law treats all citizens equally when they commit a hate crime- then that is due process. You can argue hate crimes violate due process- but I disagree, and so do many legal scholars- and the supreme court in two recent cases has upheld hate crimes enhancements (though it will not allow fighting words to be criminalized in this way- because of the conflict with free speech). I happen to agree with the Supreme Court of the Us on this- apparently you don't. Maybe you should file and amicus curiae brief next time they hear this issue.
