<I am just curious: how do you know that Ashcroft was being cynical? <

Well, I believe he was being cynical because he never brought up any questions or issues about White during the Judiciary Committee hearings on him. No Republican did and his nomination went through the whole hearing process smoothly. It was only when the nomination came to the Senate floor that he started to make his charges. By that time, there wasn't any chance for White or any other witnesses to refute what he was saying or explain his minority opinion.

Now if he was really opposed on principle why not have those questions raised during hearings where the nominee can reply and be questioned???????
