Souter didn't suggest a remand - he suggested a way of dealing with the EP issue on remand in light of the fact that 5 justices decided to take the case, reverse the FSC and remanded.

Souter says it very clearly in the first page -- SCOTUS shouldn't have taken the case, and having done so, the majority has erred yet again in how it disposed of it.
