I merely quoted from the opinion. He agreed on the equity issue. He also said, Part I-A-2:

Nevertheless, there is no justification for the majority's remedy, which is simply to reverse the lower court and halt the recount entirely. An appropriate remedy would be, instead, to remand this case with instructions...."

The "nevertheless" is a concession of the validity of the equity issue, and the use of the term "remedy" is a further acknowledgement that there is a defect to cure. Slam dunk, 7-2 on the equity issue......
