If Ashcroft is confirmed, he will be lightning rod -- ever present and able to remind people that Bush, contrary to his election-period false persona, IS a social conservative who will do everything in his power to promote a right wing social agenda. If Ashcroft is rejected, Bush will almost certainly replace him with Racicot or somebody else who is 95% as conservative as Ashcroft, but less "in your face" about it, which will be a less potent reminder that Bush is a fraud who not only lost the election, but lost it on false pretenses.

I think Ashcroft will galvanize opposition to this illegitimate administration as much or more than anybody else Bush would be likely to appoint to this post if Ashcroft goes down. And let's face it, he is not a lifetime appointee, and Bush is clearly going to give us a conservative appointment. Personally, I'd rather save my energy for the confirmation battles to come -- over lifetime judicial appointments, especially appointments to appellate courts and the USSC -- and let Bush and his right wing supprters install their lightning rod at DoJ.

That might be a good idea. By his record in Texas, he appoints very good people of moderate political persuasion. Most reasonable thing you've proposed thus far.
