January 10, 2001

"Reasonable people would call a two-year houseguest who is not a relative and who vacuums, does laundry, looks after the kids and receives free room and board and spending money a maid. But Ms. Chavez had insisted that Marta Mercado, an illegal immigrant from Guatemala who lived in her house between late 1991 and some time in 1993, was a needy charity case."

The instinct to help people is a noble one, but it cannot be a substitute for
paying someone a minimum wage. Ms. Chavez had previously
maintained that Ms. Mercado's work around the house and the cash
handouts she paid her were merely tokens of mutual appreciation, in no
way constituting an employer-employee relationship. The claim was met
with understandable skepticism. It also cast doubt on Ms. Chavez's
ability to oversee the core function of the Labor Department, which is to
define what work is and how it should be compensated."
