But I agree in the example you gave, because the pollution crossed state lines. Ditto for any regulation that affects commerce- say uniform product requirements, like auto emission standards.

The original question from the species act was whether the federal gov can require something, like an end to development, that effectively takes something you own away from you. I'm personally willing to pay to have land protected, and at least consider that an oil rich land should be developed to fund buybacks in other areas.

What if a tow truck came and took you car one morning because the grandfather clause of auto emission requirements had been eliminated. Is that OK with you?
