From the day after Election Day, both sides knew that recounts would probably help Gore -- you just have to look at the location of the old punch-card machines with their high error rates.

So the Republicans' best chance was to stop any recounts.

And they fought long and dirty to do this. The Democrats fought long and dirty too, but they had two strikes against them, first that it is always easier to use the courts to stop something than to accomplish something, and second, that the officials in charge of the election were working for Bush. Literally. That is what really rankles.

I agree the FSC decisions stunk, but to call their decisions activist while praising the SCOTUS decision?! I call selecting a presendent an activist decision. There certainly was no coherent legal reasoning behind their decision, just the desire not to, how did Scalia put it?, "cast doubt on the legitimacy of George Bush's election". Yeah, like the doubt that he actually won the election.
