The majority held, that it would be impossible for recounts to proceed, and complete by Safe Harbor day (3USC section 5) and that the desire to be complete by that time was the clear intent of the Legislature.

The majority also held that there were problems with equal protection. So your assumption is probably correct. I say probably, only because, had original time line been held, circumstances may have evolved, in such a way as to not create a situation where 'irrepairable harm' would have occurred.

I think this important because of what it teaches about Judicial activisim. Laws spend months somtimes years in committee to minimize un-intended consequences. And a court changes it with, probably less than a day of deliberation.

Reading the opinions, it becomes clear that they would have remanded with instruction, given the time. Here is the ruling. Many SCOTUS decisions are very arcane and difficult to read. This one is actually pretty easy.
