LOL. Balance, my friend. The Court is only one of three federal institutions on the federal side of the federal/states equation. The Executive and Congress are the other two parts of the federal power.

As you pointed out, that good Republican Abe Lincoln, acting in his federal Executive capacity, was the driving force behind ending slavery.

You can speculate as much as anyone else what Scalia, Rhenquist, Ashcroft, and others would have done in 1954, but it's only speculation and serves no more practical purpose than to entertain and raise passions. In 1954, John Kennedy probably would have agreed with them. Things and people do change over time.

Simply because one favors states' rights does not translate into their favoring states' rights over conflicting mandates of the US Constitution.
