The USC Bush vs. Gore decision has already spawned a whole litter of equal protection clause lawsuits regarding the way the vote is counted. There's going to be lots more before we're done.

The argument is, if you have to have a uniform standard for a recount, then you must have uniform machinery for the original vote, so using different voting machines in different districts is a violation of the equal protection clause of the Constitution.

I'll be interested to see what the courts do with this argument. It will be very expensive if they accept it, but I don't see how they can avoid it, unless the USC sticks to its "one time only" clause in Bush vs. Gore.

If they do accept it, it will benefit the Democrats, as poor urban districts tend to have the worst voting equipment now.
