5-4 , jla, 5-4. NOT 5 in the majority, 2 concurring in part and dissenting in part, and 2 dissenting. But rather, a Per Curium decision with 5 justices in the majority, and 4 in dissent.

To quote John Kenneth Galbraith: I have nothing personal against Bush, Dick Cheney, nor against Colin Powell and the others now surfacing as members of the new administration. But I will not reconcile myself to them. They lost the election. Then they arranged to obstruct the count of the vote. They don't deserve to be there, and that changes everything. They have earned our civic disrespect, and that is what we, the people, should accord them.

In social terms, civic disrespect means that the illegitimacy of this administration must not be allowed to fade from view. The conventions of politics remain: Bush will be president; Congress must work with him. But those of us outside that process are not bound by those conventions, and to the extent that we have a voice, we should use it.

I am not alone in this jla. For every right wing reactionary on an internet message board (and these boards attract right wing reactionaries far beyond their actual numbers in the public at large), there are dozens of people who are infuriated by the obstruction of vote counting and misuse of authority (i.e., Katherine Harris' unlawful interference) in Florida, the obscene decision of 5 radical conservatives in black robes, and the immoral Presidency it created. We will not forget. And we will take every opportunity to remind people like you of exactly how we feel.
