hopefully you use a cpa that is familiar with wash rules. the intent of the rule was to prohibit a tax loss artificially, without a change in your position. in your instance i think you will find that even though you established a new position within thirty days, the fact that you in essence established a second loss, will allow the loss to be taken......the wash rule was never meant to negate a true loss....your account should be able to clarify, let me know what you find out
