Speaking of Constitutional amendments, I hear Ashcroft proposed a nice one on the topic. Not quite "every sperm is sacred", but close. He's putting that all behind him, though, right?

The Constitution had no problem with slavery either, and there are people who argue that the post civil war amendments aren't really valid because the reconstruction era state governments in the south weren't "legitimate". Anyway, the Supreme Court never much held with most of the post civil war amendments till recently.

By right to an abortion, do you mean the right to have an abortion provided for you or do you mean the right to choose to have an abortion without risk of criminal charges against you or to the provider?
