Nope, shorting against the box isn't a loophole around the wash-sale rule. In fact, it TRIGGERS the wash-sale rule!

That is, if you uncover the box within the wash-sale period, you've got a wash sale.

It was a loophole, but now with the new tax law, the loophole is closed.
