Actually, whether any material is used for any purpose, higher or lower, is not relevant here... the basic underlying issue is whether the copied material is used for obtaining profit that would otherwise deprive the original author of that same personal gain... if the second pastor sold copies of his book, then the first pastor would have a case of copyright infringement... certainly, he doesn't have to file, but, yes, those laws are aimed at commercial piracy.. this is a big business..... a simple footnote referencing the original work and author is always appropriate and that would remove any question of fraud, but using previously written music, or any of its derivatives, e.g., variations and instrumental arrangements, which are still not in the public domain would still require special permission above and beyond any simple reference... the use of footnotes is done as a regular practice when writing a scientific research article for journal publication, each study contains numerous referenced articles... no copying or fraud is ever suspected.....
