Question: How does the IRS define "substantially different securities" regarding the wash sale rule?

Example: If I sell ProFunds' UOPIX at a loss and immediately purchase shares of Rydex's RYVYX, can I claim the ProFunds' loss, or does this violate the wash sale rule? Both of these funds are 2 beta NDX funds, but each one is operated by separate mutual fund companies. In addition, they use different formulas to achieve the 2 beta result. Is this "substantially different" enough?
