So I'm charged with a crime, and one of the penalties specified is loss of the vehicle used to commit the crime. But I'm found not guilty.

In a separate civil hearing I'm charged of using the vehicle in the commission of that crime and I'm found liable (is that the correct term?) and the vehicle is confiscated- -even though I've already been found not guilty of the crime. Is this the picture?

So the constitutional requirement for due process is met simply by having another hearing (and I presume this is without a jury- -correct?) and getting a different finding. Is this the procedure?

Where's my gun? We've now got a situation where the cops ARE the robbers.

<<So that's the innocent explanation of how someone can be found not guilty of drunk driving but still lose their car.>>

When I joined the Army, my mother and I went 50/50 on a CD note. She'd get the interest while I was gone and I'd get it when I got back. One year she got 3 payments and I got one. Of course the bank sent a 1099 showing me as getting all 4.

A couple of years later I got a notice from the IRS about the interest. We sent them a letter and received a case closed. Next year got another notice, sent the letter and a copy of the case closed and got another case closed. The next year got the notice, sent the letter and copies of both case closed. In response I got a warrant that they were taking my house and putting it up for sale. I sent them the $85.
