Did Sun really pick EXACTLY the same code name for their system as Compaq used for their own recently announced high end unix systems? Why would they present the opportunity for confusion? My first impression reading the article was that the guy was running a mixed mode environment with Compaq Alpha and Sun. I doubt that Sun would make a mistake like that...

Dear Mr. Magee

We represent Wildfire Communications, Inc ("Wildfire") in trademark and intellectual property matters. Wildfire is the owner of Federal trademark registrations on its trademark WILDFIRE which it presently uses to identify its communications and computers and computer-related hardware and software products and services, including its Wildfire ® electronic assistant. Wildfire has built considerable brand recognition in its products through the use of its WILDFIRE mark and from advertising and promoting its products under the mark. Like all companies, Wildfire considers this brand recognition to be a very important part of this business.

Wildfire has become aware of the use of the term WILDFIRE in connection with a new line of AlphaPowered computer servers of Compaq Computer Corporation ("Compaq"). As Wildfire is concerned about the impact of this use on Wildfire's trademark rights in WILDFIRE, we have contacted Compaq and it has agreed to only use the name "AlphaServer GS Series" as the product name for the new line of servers.

This letter has been sent to you because you have made recent use of the term WILDFIRE in connection with Compaq's new line of servers, such as in an article, an advertisement, or other publicly-available materials. Wildfire requests that you cease any use of the term WILDFIRE in reference to Compaq's new line of servers. As Compaq has informed Wildfire that it wishes to build brand equity in its new name for product, your use of "AlphaServer GS Series," rather than WILDFIRE, for Compaq's new line of servers will benefits both Compaq and Wildfire.

Please provide us with your prompt written assurance that you will comply with this request. Thank you in advance for your cooperation.
