No, the Takings Clause hasn't been repealed. If this was anywhere but California, none of this would be happening. They don't believe in a lot of the Amendments out there - the 1st, the 2nd, the 10th, why should the 5th and 14th be any different?

Hey, quit picking on the judge. I live in CA and I hereby claim my right of energy victimhood. Any lawyers think the ACLU might take my case? It's clearly a case of greedy evile (ah, a new word coined: evil + vile = evile) out-of-state fuel and power suppliers trying to bully we fine upstanding citizens of California who simply deserve all the electricity and natural gas that we want, at whatever price WE deem desirable.

Watch it or we will mobilize our Hollywood celebrity brigades to go forth across the land and claim our god-given right to all the heathen corporations' energy capacity at NO added cost to us. Meathead... Barbra... We need you now in our hour of despair.
