I had read prior to the auction that one of the negatories hanging over the auction was that bidders who were successful in this auction still had the possibility of having their spectrum reclaimed by NextWave; that their payments would be refunded, but no damages would be considered. The reduced value of the spectrum at auction due to this small problem was cited as one reason to postpone the auction until after the NextWave case could be heard.
