What a shame! A non-compete agreement should not be a problem - the AA would self-destruct anyway, so it would be moot.

One would think the Board would be looking out for their own skins.

Yeah it seems like the BoD had their chance to save the(ir)ship at that time and bailed when the direction stalled.
I really do wonder what Paul Allen has to say about all of this.
